Deputies approve the Income Law; advances to the Senate

With a vote of 352 in favor and 128 against, the Chamber of Deputies approved in general and in particular the Federal Income Law for the Fiscal Year of 2026, which is why it advanced to the Senate.

In this regard, two reservations were accepted to the original minutes, which were presented by the coordinator of the Labor Party (PT), Reginaldo Sandoval, representing his party, Morena and the PVEM.

The first of the modifications was regarding the deductibility of unpayable credits, which will now apply to all taxpayers, both individuals and legal entities.

This measure was not applied until now to financial institutions, especially banks, which generated preferential treatment in the deduction of credit that could not be settled.

The legislation seeks to equalize conditions and prevent banks from maintaining a special status, allowing all taxpayers to be governed by the same deductibility rules.

Likewise, taxpayers will have an administrative resource that will allow them to question tax decisions.

The new law requires taxpayers to support their tax credit with a bond or guarantee, to facilitate the process and prevent it from being used as a mechanism to postpone tax obligations.

On the other hand, in the case of the second reservation, this will affect insurers, since it prohibits them from crediting VAT in cases such as damages or paid insurance that comes from third parties.

Insurers will not be able to deduct VAT when managing payments on behalf of the insured and the objective is to increase equity and transparency in the Mexican tax system, benefit taxpayers and reduce the spaces for discretion in tax deductibility.
