But this did not prevent the US District Court from setting a trial date for late next March to consider Elon Musk’s allegations regarding the transformation of “Open AI” from a charitable organization into a profit-making company.

In his statement sent to Bloomberg, an OpenAI spokesperson confirmed that Musk’s unserious claims are just a clear example of his pattern of harassment, saying, “This is a waste of time.”

The legal authorities avoided responding to Toberov’s allegations or even asking OpenAI to dismiss the case. California Attorney General Rob Bonta also confirmed that OpenAI’s transformation into a for-profit company will not affect any ongoing cases, in a clear indication that Musk’s case against the company will continue on schedule.

Tobirov explained that OpenAI is trying to preempt the court and jury’s decision through last-minute restructuring, adding that the California Attorney General’s preservation of Musk’s right to sue the company has a good reason.
