Police recommend Emilie Kiser’s husband Brady be charged with abuse after son’s drowning

Chandler Police have shared a new update on the investigation into Emilie Kiser’s son’s drowning, and they recommended that Brady be charged with abuse.

Trigg Kiser died on 18th May after drowning in their garden pool six days earlier. The toddler was being looked after by his dad while Emilie was out with friends.

Brady told police he got distracted by his newborn and lost sight of the three-year-old for three to five minutes before finding him floating in the pool.

In a new statement shared on X on Tuesday (15th July), Chandler Police confirmed they have finished the investigation and recommended a child abuse charge.

“The Chandler Police Department has completed its investigation into the tragic drowning of three-year-old Trigg Kiser, who died May 18, 2025, after being found unresponsive in his family’s backyard pool,” they said.

“Following a thorough review of the evidence, investigators have recommended a Class 4 felony charge of child abuse against Brady Kiser. The case has now been submitted to the Maricopa County Attorney’s Office for review.”

It is now down to the Maricopa County Attorney’s Office to review the recommendation and decide any “potential prosecutorial decisions,” police said.

As explained by Salwin Law Group, a Class 4 felony in Arizona is in the “middle-range of severity” for felony crimes. It is more severe than a Class 5 felony, but less severe than a Class 3 felony.

The sentencing range for a Class 4 felony is usually between one and 3.75 years for a first offence, but a person could be eligible for probation if this is their first felony. A conviction can also result in fines.

In the state of Arizona, crimes are split into felonies and misdemeanors. Felonies are more serious, and can lead to longer prison sentences. However, misdemeanors can also be punished with jail time.

Some other types of Class 4 felonies can include aggravated assault, burglary, criminal damage worth over $10,000, robbery, forgery, misconduct involving weapons and possession of narcotic drugs.

Emilie and Brady Kiser have not publicly spoken out since the death of their son.
