Emilie Kiser has filed another lawsuit requesting to redact information from the police report that reveals why police wanted to charge her husband Brady Kiser over their son’s drowning. She wants the details removed so they aren’t released to the public.
On 16th July, Chandler police completed their investigation into the influencer’s son’s death and recommended that Brady be charged with a Class 4 child abuse felony. Three-year-old Trigg drowned in their garden pool on 12th May, while he was being looked after by his dad.
However, in an update on 25th June, Maricopa County Attorney Rachel Mitchell revealed that Brady Kiser would not be charged with child abuse as there was “no reasonable likelihood of conviction”.
Following the charge decision, Emilie Kiser has now filed a lawsuit to remove details from two pages of the Chandler Police Department’s official report about their son’s drowning that explain why there was a police investigation and charge recommendation.

In court documents obtained by People, lawyer Kelley said: “The section of the report Ms. Kiser seeks to redact contains information and context that is critical to provide the public a reasonably full understanding of the investigation of the drowning, the police department’s decision to recommend criminal charges and the county attorney’s decision not to pursue criminal charges.”
The influencer wants this redacted because she is concerned that if the report was made public, the details could be used to make “disturbing” content surrounding their son’s death, with tools such as AI.
This is the third lawsuit Emilie has filed. She first sued Arizona officials to stop information relating to the investigation from being publicly released, including things like the police report, body camera footage, scene photos, 911 calls and the autopsy report.
Then, she filed a second suit to keep a specific document called her “personal declaration” private. This was a detailed account written by her that described the toddler’s drowning in full.
