Commission Approves Loss of Nationality in the Penal Code

The parliamentary Committee on Constitutional Affairs approved this Friday, in particular, the sanction of loss of nationality, which will be introduced into the Penal Code.

Chega made the majority of the Government’s proposals in the new diploma viable and the PS, which had initially said it would vote against almost all of the diploma, ended up making the ten-year period after acquiring nationality viable as the period in which the additional sanction can be applied.

In the paragraph that defines that the amendment to the Penal Code refers to facts that “have been committed within 10 years after acquiring nationality”, Chega initially – which defends, in its own amendment, that the period should be 20 years -, PS and Livre voted against, which would lead to the measure’s collapse.

The PS then changed its voting direction and ended up making the Government’s proposal viable, abstaining.

Socialist Pedro Delgado Alves regretted that the Government did not want to dialogue with the PS and recalled that this change creates “situations of discrepancy between citizens” and “people who commit the same illegal act are now covered differently”.

The changes only affect naturalized citizens who maintain dual nationality who have been sentenced “to an effective prison sentence of four years or more”, states the diploma.

The socialist considered that the “list” of crimes “is so extensive that any binational runs the risk of losing their nationality”.
