Court hears Julius Malema ‘not a candidate for imprisonment’

A private social worker told the East London Regional Court that Economic Freedom Fighters (EFF) leader Julius Malema is not a suitable candidate for direct imprisonment.

Malema was appearing before the court for pre-sentencing proceedings following his conviction for discharging a firearm during the EFF’s fifth anniversary celebrations at Sisa Dukashe Stadium in Mdantsane in 2018.

He was found guilty of unlawful possession of a firearm and ammunition, discharging a firearm in a built-up area, and reckless endangerment.

No physical harm caused

Delivering a pre-sentencing report, social worker Jessie Thompson told the court that no physical harm was caused during the incident and that the firearm was discharged in a celebratory manner, without any intention to commit violence.

Thompson further described Malema as a respected community figure, citing his involvement in charitable initiatives and community development work across the country.

“After a thorough assessment of the accused’s personal circumstances, the seriousness of the offences, societal interests and the relevant legislation, the following sentencing proposal is made,” Thompson said.

She recommended that the court impose a fine that reflects the seriousness of the offences, with the fine suspended to encourage continued lawful behaviour.

Monetary donation

She also proposed that Malema be restricted from obtaining a firearm licence for a specified period as a deterrent, and that he be required to make a monetary donation as restitution to Gun Free South Africa, a non-governmental organisation focused on reducing gun violence in the country.

Malema was convicted in October last year and has consistently maintained that the case against him is politically motivated.

The pre-sentencing proceedings was postponed to Wednesday, 15 April 2026 for closing arguments.
