The plenary session of the Chamber of Deputies generally approved the presidential initiative to issue the General Law to prevent, investigate and punish crimes related to extortion, which approves the classification of this scourge at the national level, and proposes sanctions of up to 25 years in prison to those who commit it.
It was unanimously endorsed by 456 votes in favor by all parliamentary groups.
The debate focused on the penalties established in the reform, since the opposition He criticized that various states in the country have penalties higher than those established by law, which they claimed could free more than 500 prisoners sentenced for extortion.
Extortion Law proposes penalties of up to 25 years in prison
Due to the above, it proposes establishing a basic criminal offense for the crime of extortion, with a penalty of 6 to 15 years in prison and a fine 100 to 500 five hundred times the daily value of Unit of Measurement and Update.
The law contemplates 34 aggravating circumstances divided into 3 categoriesorganized according to the severity of the impact on the type of protected legal asset.
Finally, it proposes a third category of aggravating circumstances in order to increase the penalty, from half to two thirds more, that is, up to 25 years in prison in the case of those behaviors that imply a serious impact on the integrity of the victim, the character of the person who commits the crime, as well as the economic and social impact.
“Among the aggravating factors proposed in this section, the use of physical, moral or psychological violence stands out, the simulation of a traffic event (“crashes”), when committed by a public servant or former public servant, armed persons intervene, minors are used or the economy of a federal entity is directly affected,” the document states.
