In Germany, several district heating providers are currently at the center of legal disputes initiated by the Federal Association of Consumer Organizations. These lawsuits are directed against companies such as E.ON and Hansewerk Natur, which have come under fire for their price adjustment formulas. The consumer advice center argues that these formulas do not comply with legal requirements and therefore call into question the basis for the recent price increases.
District heating customers often have no choice, as there is usually only one provider in a supply network. This monopoly makes it difficult for consumers to switch providers if they are dissatisfied. The current situation highlights the need for greater regulation and monitoring of pricing in monopolistic markets.
While the lawsuit against Stadtwerke Neubrandenburg has not yet been officially served, a spokeswoman for the company emphasizes that an external audit has confirmed the legal conformity of its price adjustment formula. Nevertheless, the Rostock Higher Regional Court plans to continue the accompanying injunction action in 2026.
The Federal Cartel Office is also investigating the price adjustment clauses of several district heating providers. They are said to have applied abusively high price increases in the period from 2021 to 2023. Proceedings have already been initiated against seven municipal utilities, although suspicion has increased in four of the nine networks examined. The details of the companies affected are not yet known, but the investigations could have far-reaching consequences for the industry.
