They ratify protection for José Luis Abarca

MEXICO CITY.- A federal court ratified the protection granted to José Luis Abarca Velázquezformer mayor of Iguala, Guerrero and alleged involved in the Ayotzinapa case in 2014.

With the recent measure, a new hearing was ordered to review the justified preventive detention measure that was imposed for the crimes of organized crime and operations with resources of illicit origin.

This resolution was issued by the First Collegiate Court in Criminal Matters of the State of Mexico in response to arguments made about Abarca’s deteriorating state of health.

The foregoing annulled the justified preventive detention issued on December 14, 2023, and a new hearing was ordered.

The aforementioned court unanimously rejected the appeal for review filed by the Attorney General’s Office (FGR).

This forces the judicial authorities to assess whether the former mayor can face the process in freedom given his current clinical state.

We remember that Abarca’s defense argues that the precautionary measure is disproportionate and does not take into adequate consideration the medical evidence that proves various diseases.

In July 2024, the judge Everardo Maya Arias granted the protection and requested that Abarca’s conditions be evaluated to determine if they are severe, terminal or chronic complex degenerativeor if they are controllable and do not represent a life risk.

He also ordered that it be determined whether the prison system has the technical and operational capacity to adequately address these conditions.
