UN: Foreign Affairs rejects the procedure of article 34 on forced disappearance


In a statement issued by the Ministry of Foreign Affairsthe organism rejects the consideration of a United Nations General Assembly to address the issue of forced disappearances in Mexico.

The United Nations World Organization (UN)in April 2025, announced to Mexico that it would implement the procedure provided for in Article 34 of the International Convention for the Protection of All Persons against Forced Disappearances, which involves international representatives in an Assembly to determine whether a widespread or systematic practice of forced disappearance is maintained in a territory, that is, whether or not the State is involved in this criminal practice.

Given this situation, Hector Vasconcelos y Cruzpermanent representative of Mexico to the UN, declared during the session of the United Nations General Assembly, held this week in Mexico City, that the country “does not agree with the Committee’s decision to activate the procedure provided for in article 34 of the Convention”.

The diplomat maintained that Mexico is one of the countries most open to international scrutiny, as demonstrated by the ratification of all Human Rights Treaties, so the statements issued by the Committee lack support and are not admissible.

In the statement issued by RE, it is stated that The phenomenon of forced disappearance in Mexico is mainly linked to organized crime. As for the Government, a National Strategy for the Construction of Peace and Security is implemented, while the National Registry of Missing and Unlocated Persons is advanced and strengthened.

Furthermore, it is maintained that in Mexico the institutions in charge of searching and identifying people have been strengthened, new inter-institutional coordination tools have been developed and a permanent and constructive dialogue is maintained with families and groups of victims. These efforts reflect the State’s commitment to truth, justice and comprehensive reparation.

The Ministry of Foreign Affairs reiterated that cooperation is the fundamental principle that must govern the relationship between treaty bodies and States, and stated that it has maintained a permanent dialogue with the Committee, to which it was presented in a detailed report that, it considers, must be analyzed objectively before issuing new judgments on the matter.
